BIOFIX CONSULTORIA S.A.S. BIC, a commercial company dedicated to business management, consulting, and experimental research in the field of natural sciences with NIT 901166791-9, and its principal office located at Avenida Carrera 45 no. 108A – 40 Ofi. 404, Edificio Bosch, Bogotá D.C., hereinafter referred to as the Company, recognizes the importance of the security, privacy, and confidentiality of the personal data of its employees, clients, suppliers, and, in general, all its stakeholders for whom it processes personal information.

In accordance with the provisions established in Statutory Law 1581 of 2012 and Regulatory Decree 1377 of 2013, BIOFIX CONSULTORÍA S.A.S. BIC defines its personal data protection policy to ensure compliance with the law and, in particular, to address inquiries and complaints from the data subjects.

The company, as the responsible party for the security and quality of the information processing, and in compliance with Article 15 of the Political Constitution of Colombia, the current regulations on personal data protection, and especially Law 1581 of 2012, Decree 1377 of 2013, and any other provisions that amend, add, or complement them.

This Policy is directed to our employees, partners, suppliers, and in general, our stakeholders for whom the Company processes personal information.

In the course of its activities and management, and in order to provide collaboration between the companies of the BIOFIX GROUP, during the execution of its activities, it may jointly process personal data with other companies within the Corporate Group, or with those who represent its rights before the data subjects. The company will provide the necessary educational and training spaces for its employees to become familiar with the regulations related to personal data protection.

The concepts presented below are the result of the provisions outlined in Law 1581 of 2012 and Article 15 of the Political Constitution of Colombia.

Authorization: Prior, express, and informed consent of the Data Subject to carry out the processing of personal data.
Database: An organized set of personal data that is subject to processing.
Personal Data: Any information linked to or that can be associated with one or more determined or determinable natural persons.
Data Processor: A natural or legal person, public or private, who, alone or in association with others, processes personal data on behalf of the Data Controller.
Data Controller: A natural or legal person, public or private, who, alone or in association with others, decides on the database and/or the processing of the data.
Data Subject: A natural person whose personal data is subject to processing.
Processing:
Any operation or set of operations performed on personal data, such as collection, storage, use, circulation, or deletion.

Area in charge of Personal Data Protection/Privacy Officer: Responsible within the Company for overseeing, controlling, and promoting the implementation of the Personal Data Protection Policy.
Public Data: Data that is not semi-private, private, or sensitive. Public data includes, among others, data related to a person’s civil status, profession or occupation, and their status as a merchant or public servant. Due to its nature, public data may be contained, among other sources, in public records, public documents, official gazettes, and court rulings that are not subject to confidentiality.

Semi-private Data: Semi-private data is neither intimate, reserved, nor public, and its knowledge and disclosure may be of interest not only to its Data Subject but also to certain sectors or groups of people, or society in general.
Sensitive Data: Sensitive data refers to data that affects the privacy of the Data Subject or whose improper use could lead to discrimination, such as data revealing racial or ethnic origin, political orientation, religious or philosophical beliefs, membership in unions, social organizations, human rights groups, or political party interests, as well as data related to health, sexual life, and biometric data.
Transfer: A transfer of data occurs when the Data Controller or Data Processor of personal data, located in Colombia, sends the information or personal data to a recipient, who is also the Data Controller and is located either within or outside the country.
Transmission: Processing of personal data involving communication of the data within or outside the territory of the Republic of Colombia when the objective is to carry out processing by the Processor on behalf of the Controller.
Interest Groups: Refers to natural and legal persons who, despite having their own objectives (employees, ethnic communities, suppliers, investors, business partners, sponsors, and any other data subject), are directly or indirectly related to the development of the corporate purpose of BIOFIX CONSULTORÍA S.A.S. BIC. Thus, their involvement is currently or will be in the future linked to the company’s activities.

The processing of data for all individuals who, at any time, due to the activities carried out by the company, have provided their personal data through the different service channels of BIOFIX CONSULTORÍA S.A.S. BIC, will be carried out within the legal framework that regulates the matter and will be all necessary for the fulfillment of the institutional mission.

  • Clients

BIOFIX CONSULTORÍA S.A.S. BIC will process personal data for the purposes of the contracts that have been signed, all in accordance with the regulations that specifically govern the matter.

  3. Transmit and/or transfer to entities with which BIOFIX CONSULTORÍA S.A.S. BIC has a contractual relationship, such as suppliers, auditors, and collaborators, within the framework of the corresponding labor relationship.
  4. Request and access data for training purposes in the development of their functions as employees of BIOFIX CONSULTORÍA S.A.S. BIC.
  • Candidates

The personal data provided by candidates in their resumes during the selection process of BIOFIX CONSULTORÍA S.A.S. BIC will be stored in databases and used for the following purposes:

  1. Share job offer information across the Biofix Group companies, their requirements, and application mechanisms.
  2. Evaluate, investigate, and determine the candidate’s compliance with the job requirements and the company they are applying to.

  3. Create a consolidated list of workers, suppliers, and clients of the company.

  13. Carry out necessary activities to fulfill and develop the contractual relationship and/or services.
  14. Send commercial information about carbon credit products.
  15. For statistical, control, and supervision purposes to support our activities.

The processing of data is prohibited, except when dealing with publicly available data, in accordance with Article 7 of Law 1581 of 2012, and when such processing complies with the following parameters and requirements:

  1. It must respond to and respect the best interests of children and adolescents.
  2. It must ensure the respect of their fundamental rights.

BIOFIX CONSULTORÍA S.A.S. BIC will process data of minors only when these conditions are met. For the purpose of authorization, the legal representative of the child or adolescent will provide consent, ensuring that, to the extent possible, the minor will be heard and their opinion will be valued, considering their maturity, autonomy, and ability to understand the matter.

BIOFIX CONSULTORÍA S.A.S. BIC must inform the Data Subject in advance that, due to the sensitive nature of the data, they are not obligated to authorize its processing. Through this document, the Data Subject is informed about the existence of BIOFIX CONSULTORÍA S.A.S.   1. In this regard, it will use the data solely for the purposes for which it is duly authorized. In the processing and protection of personal data, BIOFIX CONSULTORÍA S.A.S. BIC will have the following duties, without prejudice to others established in the regulations governing or that may govern this matter:

  6. Rectify incorrect information and communicate the relevant changes to the Data Processor.
  7. Provide the Data Processor only with data whose processing has been previously authorized, in accordance with Law 1581 of 2012.
  8. Ensure that the Data Processor respects the security and privacy conditions of the Data Subject’s information at all times.
  9. Handle inquiries and complaints in the terms specified in Law 1581 of 2012.
  10. Inform the Data Processor when certain information is disputed by the Data Subject, once the complaint has been filed and the relevant process has not yet been completed.
  11. Upon the Data Subject’s request, provide information about the use made of their data.
  12. Inform the data protection authority when security breaches occur, and there are risks in managing the Data Subjects’ information.
  13. Comply with the instructions and requirements issued by the Superintendence of Industry and Commerce.

BIOFIX CONSULTORÍA S.A.S. BIC requires the free, prior, express, and informed consent of the Data Subject for the processing of their personal data, except in cases expressly authorized by law. The consent of the Data Subject must be requested by the Data Controller no later than at the time of data collection and must be granted in writing, orally, or through unequivocal conduct by the Data Subject that allows concluding that they have given their consent. The silence of the Data Subject will not be interpreted as unequivocal conduct.

The authorization for BIOFIX CONSULTORÍA S.A.S. BIC to process personal data will be granted by:

  • The Data Subject, who must verify their identity sufficiently through the different means provided by BIOFIX CONSULTORÍA S.A.S. BIC.
  • The heirs of the Data Subject, who must prove such status.
  • The representative or attorney of the Data Subject, upon accreditation of the representation or power of attorney.
